4. Acceptable Use Policy

5. Subscription and Payment

5.1 Billing: ActionSender operates on a subscription basis. Payments are processed securely through Stripe.

5.2 Pricing: Subscription fees are based on the selected plan and are billed monthly. Pricing is subject to change with 30 days notice.

5.3 Refunds: We offer a 30-day money-back guarantee. Refund requests must be submitted within 30 days of initial purchase.

5.4 Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.

6. Service Limits and Usage

Each subscription plan has specific limits regarding:

• Number of contacts
• Messages per contact
• Total monthly messages
• Number of phone numbers

Exceeding these limits may result in service interruption or additional charges.

7. Intellectual Property

All content, features, and functionality of ActionSender, including but not limited to software, text, graphics, logos, and trademarks, are the exclusive property of Scratchive and are protected by international copyright, trademark, and other intellectual property laws.

You retain all rights to your data and content uploaded to the Service.

8. Data and Privacy

Your use of ActionSender is also governed by our Privacy Policy. We collect, use, and protect your data as described in the Privacy Policy.

You are responsible for ensuring you have proper consent to message your contacts and comply with applicable data protection laws (GDPR, CCPA, etc.).

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCRATCHIVE AND ACTIONSENDER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Service Availability

We strive to provide 99.9% uptime but do not guarantee uninterrupted service. We may suspend the Service for maintenance, updates, or in case of security concerns.

11. Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms of Service
• Fail to pay subscription fees
• Engage in fraudulent or illegal activities
• Abuse the Service or negatively impact other users

ActionSender integrates with WhatsApp and other third-party services. Your use of these services is subject to their respective terms and policies. We are not responsible for third-party services or their actions.
